The Supreme Court (SC) has overturned the suspension of Nepali Congress MP Tek Bahadur Gurung, which had been imposed by the Parliament Secretariat. Gurung, representing Manang in Parliament, had been suspended by the Parliament Secretariat on December 27, 2022. This action came after he and 14 others were accused of abusing authority by the Commission for the Investigation of Abuse of Authority on February 4, 2019.

The Parliament Secretariat had suspended Gurung under Section 2 (d) of the Prevention of Corruption Act, 2059, pending a final verdict. However, following constitutional amendments to the law, Tek Bahadur Gurung lodged an appeal with the Supreme Court on March 5, 2023. The SC ruled in Gurung’s favor, accepting his writ petition to revoke the suspension order. Justices Manoj Kumar Sharma and Binod Sharma, comprising the division bench, issued the order to annul the suspension.

It is noteworthy that on February 28, 2020, the Special Court had found Gurung and nine others guilty of corruption linked to the misuse of public property at Bhrikutimandap, Kathmandu.
